GENERAL PROVISIONS

  • The online store operating at http://mobilnelustra.pl is run by Elżbieta Migoń conducting business activity under the company name grafiQa Elżbieta Migoń, registered in the Central Register and Information on Business Activity of the Republic of Poland conducted by the minister responsible for the economy, the address of the place of business and the address for deliveries: ul. Stepowa 8 D, 30-698 Kraków, NIP: 9930042440, REGON: 121218432, e-mail address: bok@grafiQa.pl, tel. 695 918 131.

    The mobilnelustra.pl online store operates on the principles set out in this Regulations.

  • The Regulations specify the types and scope of services provided electronically by the mobilnelustra.pl online store, the rules for providing these services, the conditions for concluding and terminating Product Sales Agreements, as well as the procedure for handling complaints. Each Service Recipient, from the moment of taking actions aimed at using the Services of the mobilnelustra.pl online store, is obliged to comply with the provisions of these Regulations.

  • The condition for placing an Order in the Online Store by the Customer is to familiarize themselves with the Regulations and accept its provisions at the time of placing the Order.

  • The online store conducts retail sales via the Internet.

  • All Products offered in the Online Store are new, free from physical and legal defects, and have been legally introduced into the Polish market.

  • The Products have a manufacturer's warranty applicable in Poland.

  • In matters not regulated in these Regulations, the provisions of: the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended), the Act on consumer rights of May 30, 2014 (Journal of Laws 2014, item 827), the Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), and other relevant Polish laws and regulations apply.

 

DEFINITIONS

  • WORKING DAY - one day from Monday to Friday, excluding public holidays.
  • ORDER FORM - a form available on the mobilnelustra.pl website allowing the placing of an Order.
  • CONSUMER - a natural person who performs a legal act with an entrepreneur not directly related to their business or professional activity.
  • CUSTOMER - a Service Recipient who intends to or has concluded a Product Sales Agreement with the Seller.
  • REGULATIONS - these regulations of the online store. ONLINE STORE - the online store of the Service Provider operating at mobilnelustra.pl.
  • SELLER, SERVICE PROVIDER - grafiQa Elżbieta Migoń with its registered office in Krakow at ul. Stepowa 8 D, 30-698 Kraków, NIP: 9930042440, REGON: 121218432.
  • PRODUCT - a movable item available in the Online Store, which is the subject of a Product Sales Agreement between the Customer and the Seller.
  • PRODUCT SALES AGREEMENT - a Product Sales Agreement concluded between the Customer and the Seller through the Online Store.
  • SERVICE RECIPIENT - a natural person, legal person or organizational unit without legal personality, to whom the law grants legal capacity and who uses the Electronic Service.
  • ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Service Recipient through the Online Store.

 

TYPE AND SCOPE OF ELECTRONIC SERVICES

  • The Service Provider enables the use of Electronic Services through the Online Store, which involves the possibility of concluding a Sales Agreement for a Product with the Seller.
  • The provision of Electronic Services to Service Recipients in the Online Store takes place on the terms specified in the Regulations.
  • The Service Provider has the right to place advertising content on the Online Store's website. Advertising content referred to in the previous sentence is an integral part of the Online Store and the materials presented on it.

 

 

CONDITIONS FOR PROVIDING AND CONCLUDING AGREEMENTS FOR THE PROVISION OF ELECTRONIC SERVICES

  • The provision of the Electronic Service specified in Chapter III, point 1 of the Regulations by the Service Provider is free of charge.
  • The agreement for the provision of an Electronic Service consisting of enabling an Order to be placed in the Online Store is concluded for a specified period and terminates upon placing the Order or discontinuing its submission by the Service Recipient.
  • Technical requirements necessary for cooperation with the teleinformation system used by the Service Provider include: a computer with access to the Internet, access to electronic mail, an Internet browser: Internet Explorer version 8 or higher, Firefox version 20 or higher, Google Chrome version 26 or higher, Opera version 11.64 or higher, any screen resolution, enabling Cookies and Javascript in the Internet browser, minimum application resolution: 800x600, recommended resolution 1024x768 or higher.
  • The Service Recipient is obliged to use the Online Store in a manner consistent with the law and good practices, taking into account the respect for personal rights and intellectual property rights of third parties.
  • The Service Recipient is obliged to provide data consistent with the actual state of affairs. The Service Recipient is prohibited from providing content of an unlawful nature.

 


TERMS OF SALE AGREEMENT

  • The information contained on the Internet Store's websites does not constitute an offer within the meaning of applicable law. By placing an Order, the Customer submits an offer to purchase a specific Product on the terms specified in its description.
  • In the event of unavailability of some or all of the Products included in the Order, the Customer is notified by email or telephone and asked to make a decision regarding further execution (cancellation of the Order, execution without the missing Products, longer waiting time for execution, selection of another Product in place of the missing one).
  • The price of the Product displayed on the Internet Store's website is in Polish zloty (PLN) and includes VAT, customs duties, and all other components. The price includes the cost of Product delivery.
  • The price of the Product displayed on the Internet Store's website is binding at the time of the Customer placing the Order. This price will not change regardless of changes in the prices in the Internet Store that may occur in relation to individual Products after the Customer places the Order.
  • Products on sale have a limited number of units, and Orders for them will be processed in the order of their receipt until the stocks of the given Product are exhausted. In order to place an Order, the Customer is not required to register an account in the Internet Store.
  • Orders can be placed via the website using the Order Form (mobilnelustra.pl Internet Store) - 24 hours a day, all year round.
  • Conclusion of a Sales Agreement In order to conclude a Sales Agreement, it is necessary for the Customer to place an Order in advance. After placing the Order, the Seller immediately confirms its receipt, which binds the Customer to the Order and at the same time accepts the Order for execution.
  • Confirmation of receipt of the Order is made by sending an email message, which includes: The Seller's statement of receipt of the Order.
  • Confirmation of all essential elements of the Order, A statement on the right to withdraw from the agreement, Information on the right to withdraw from the agreement, These Regulations. Upon receipt of the email message referred to in point 8 letter b by the Customer, a Sales Agreement is concluded between the Customer and the Seller.
  • Orders placed on weekdays after 5:00 p.m., on Saturdays, Sundays, and holidays will be considered on the next working day.
  • Each Sales Agreement will be confirmed by a receipt or, at the Customer's request, an invoice, which will be attached to the shipments.
  • If the Customer wants to receive an invoice in the Order Form, they should select the "VAT INVOICE" option and complete all the fields with the necessary data for its issuance.
  • Discounts for customers with a user account on the mobilnelustra.pl website apply only and exclusively to Mobile Mirror rental services.

 

 

METHODS OF PAYMENT

  • The seller provides the following payment methods: Payment upon collection in Krakow Traditional bank transfer to the seller's bank account or via the payment operator Transferuj.pl

  • The customer is obliged to make payment for the sale contract within 7 days from the day of its conclusion, unless the sales contract provides otherwise.

  • In the case of payment by bank transfer, the product is sent after the payment has been credited to the seller's bank account.

  • In the case of payment upon collection, the shipment is sent after verifying the correctness of the address data.

 

 

COST, DELIVERY TIME AND METHODS

  • The costs of delivering the product are determined during the ordering process and depend on the chosen payment and delivery method of the purchased product.
  • Products purchased in the online store are shipped via courier companies DHL or UPS or the seller's own transport.
  • Delivery costs do not include product assembly or bringing the product to the customer.
  • The delivery time of the product consists of the time needed to complete the product and the time it takes for the carrier to deliver the product: The time needed to complete the product is up to 10 working days.
  • Product delivery by the carrier takes place within the time declared by the carrier, from 24 hours to 3 working days if the shipment cannot be delivered on non-working days.

 

  • COMPLAINT PROCEDURE
  • Complaints regarding warranty: The basis and scope of the Seller's liability towards the Customer who is a Consumer, for defects in the physical and legal aspects of the Product, are determined by the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
  • Notifications of defects regarding the Product and submission of the relevant claim can be made via e-mail to the address: bok@grafiQa.pl or in writing to the address: ul. Stepowa 8 D, 30-698 Krakow.
  • If it is necessary to assess physical defects in the Product, it should be delivered to the address: ul. Stepowa 8 D, 30-698 Krakow.
  • The Seller shall respond to the Customer's request without undue delay, no later than within 14 days. The response to the complaint is sent to the e-mail address provided by the Customer or in any other manner indicated by the Customer.
  • Complaints related to the provision of Electronic Services by the Service Provider: Complaints related to the provision of Electronic Services via the Online Store can be submitted by the Service Recipient via e-mail to the address: bok@grafiQa.pl or in writing to the address: ul. Stepowa 8 D, 30-698 Krakow. In the above e-mail message, as much information and circumstances regarding the subject of the complaint as possible should be provided, in particular the type and date of occurrence of the irregularity, as well as contact details.
  • The information provided will significantly facilitate and expedite the consideration of the complaint by the Service Provider.
  • The Service Provider shall consider the complaint without undue delay, no later than within 14 days.
  • The Service Provider's response to the complaint is sent to the Service Recipient's e-mail address provided in the complaint or in any other manner indicated by the Service Recipient.

 

 

RIGHT OF WITHDRAWAL

  • A customer who is also a consumer and who has concluded a distance contract may withdraw from it without giving any reason by submitting an appropriate written statement within 14 days. To meet this deadline, it is sufficient to send a statement of withdrawal from the contract or to attach it to the package with the returned product.

  • In the event of withdrawal from the contract, the Sales Agreement is considered as not concluded, and the Consumer is released from all obligations. What the parties have provided is returned in an unchanged condition, unless the change was necessary within the limits of ordinary management. The return should take place immediately, no later than within 14 days.

  • The Seller will refund the value of the Product together with the costs of its delivery using the same method of payment that the Consumer used, unless the Consumer has clearly agreed to another way of refund, which does not entail any costs for him/her.

  • If the Consumer has chosen a method of delivery of the Product other than the cheapest ordinary method of delivery offered by the Online Shop, the Seller is not obliged to refund the additional costs incurred by the Consumer.

  • The Consumer who withdraws from the Sales Agreement, in accordance with point 1 of this chapter, bears only the costs of returning the Product to the Seller.

  • The fourteen-day period in which the Consumer may withdraw from the contract shall be counted from the day on which the Consumer takes possession of the Product.

  • The right of withdrawal from a distance contract does not apply to a Consumer in the case of a Sales Agreement in which the subject of the service is an item that is not prefabricated, manufactured according to the Consumer's specifications, or serving to satisfy his/her individual needs.

 

 

PRIVACY POLICY (PERSONAL DATA PROTECTION)

  • The Online Shop cares about the privacy of its customers. The Online Shop uses appropriate technical and organizational measures to protect processed data. All transmitted data is secured against unauthorized disclosure, as well as against their processing in violation of applicable law.
  • The possibility of processing personal data arises from the consent of the customers themselves, as well as from legal authorizations to process data necessary to fulfill the Order, as well as to handle any complaints and to facilitate any future purchases. These data are not processed or used for any other purpose.
  • Providing any personal data is voluntary. The Online Shop customer has the right to access the content of his/her data, as well as to correct them, and to demand their discontinuation of use or deletion.
  • Data provided by the customer of the Online Shop is used for accounting purposes, contacting the customer, and for other activities related to the performance of the Sales Agreement. The current customer data will be made available to other entities if necessary to execute the agreement.
  • In accordance with applicable law, customer data may be disclosed to entities authorized to receive them, including competent judicial authorities.

 

 

COOKIES

  • The Service Provider's online store uses "cookies" files. Failure to change the browser settings by the Service Recipient is tantamount to consenting to their use.
  • The installation of "cookies" files is necessary for the proper provision of services in the online store.
  • The "cookies" files contain information necessary for the proper functioning of the online store, especially those requiring authorization.
  • The content of "cookies" files does not allow for the identification of the Service Recipient.
  • Personal data is not processed or stored using "cookies" files.

 

 

FINAL PROVISIONS

  • Agreements concluded through the online store are concluded in accordance with Polish law.
  • Changes made to the online store's regulations by the Service Provider are binding on the Service Recipient, provided that they have been properly informed about the changes and have had the opportunity to familiarize themselves with them.
  • None of the provisions of the regulations aim to violate the rights of the Service Recipient.
  • In the event of any inconsistency between any provision of the regulations and applicable law, the Service Provider declares absolute subordination and application of that law in place of the disputed provision of the regulations.
  • Any disputes arising from sales agreements between the online store and consumers will be resolved in the first instance through negotiations, with the intention of amicably resolving the dispute.
  • However, if this is not possible or is unsatisfactory for either party, disputes will be resolved by the appropriate common court.
